EPA expresses concern for substantial loss and/or degradation of water quality and other aquatic ecosystem in waters of U.S.

The US Army Corps of Engineers is responsible for issuing Rosemont Copper operation a Clean Water Act section 404 permit that would regulate 101.6 acres of waterways, which would be subject to pollution and sediment flow from mining operations. US Environmental Protection Agency (EPA) Region 9 is questioning if a permit can adequately protect Davidson Canyon and Cienega Creek "outstanding waters."
