EPA and Phelps Dodge entered into a Consent Decree in November 2003. In the Consent Decree, Phelps Dodge agreed to conduct reclamation of the 300-Level stockpile, address potential discharges from a seep at the base of the 300-Level stockpile into the tributary of Bitter Creek, and address water discharges from Section House Canyon into the tributary of Bitter Creek. EPA issued Order for Compliance No. IX-FY90-33 that pertains to the Clarkdale Tailing Impoundment. In September 1995, ADEQ issued APP #101076 under the Multi-Sector General Storm Water Permits Program, for the Clarkdale Tailing Impoundment. The APP is for closure and post-closure activities at the impoundment. The activities include surface water and groundwater monitoring, and capping of the tailings impoundment upon cessation of the discharge of effluent from the Town of Clarkdale. ADEQ is in the process of issuing an APP (P-100536) for the United Verde Mine, as required by the Consent Decree. The facilities that require an APP consist of one new impoundment, the Hopewell South Stockpile Seepage Containment Facility, and 34 existing seepage and non-storm water collection impoundments. Twenty-one of the 34 existing impoundments are proposed to be upgraded and combined into 7 active, existing facilities and 13 are proposed to be closed. The APP reportedly will be issued in 2005.
